10th Circuit Court rules in favor of ethanol groups

The 10th Circuit Appeals Court has struck down three small refinery exemptions under the Renewable Fuel Standard.  The court decided in favor of the Renewable Fuels Association, the National Corn Growers Association, the American Coalition for Ethanol and National Farmers Union, ordering the EPA’s exemptions to CVR Energy and HollyFrontier vacated.

The court’s ruling says the EPA went beyond its
authority in granting these three exemptions.  The court also says the EPA
cannot extend exemptions to any small refineries whose temporary exemptions had
lapsed.

National Corn Growers Association President
Kevin Ross says he’s optimistic this decision will put an end to the demand
destruction caused by waivers and keep the RFS back on track.

This case was filed in 2018 and the court issued its ruling Friday.
