Brief filed in two groups’ suit over EPA dicamba approval

The lawyers for two groups who filed a lawsuit against the EPA and its approval of XtendiMax, Monsanto’s dicamba herbicide in January, filed a brief in the case last week, August 14th.

The National Family Farm Coalition
and the Center for Food Safety sued the EPA’s approval of XtendiMax in 2017 but
the Ninth Circuit Court of Appeals said the lawsuit was moot. The court said
the groups could file again after EPA’s re-approval of dicamba products in
2018.

The groups say the EPA did not
properly analyze the risk of drift and damages from dicamba to off-target
crops, trees and shrubs. XtendiMax is now owned by Bayer.
